Donald Trump is expected to drop a $100 million lawsuit over Palm Beach International Airport, now that winning the presidency may keep planes from buzzing over his Palm Beach estate.A Trump representative on Monday notified Palm Beach County that the 2015 lawsuit would be voluntarily dismissed, County Attorney Denise Nieman said via email.Trump for two decades has waged a legal fight with the county to try to keep noisy aircraft traffic away from Mar-a-Lago — his oceanfront club and part-time residence.Yet thanks to security precautions, the president-elect may not need a lawsuit to keep planes away from the historic estate.The Federal Aviation Administration has already created a temporary no-fly zone over Trump Tower in New York and is working with the U.S. Secret Service on potential flight restrictions when Trump is at Mar-a-Lago.
When a president flies into the airport in West Palm Beach, nearby air traffic can be temporarily grounded. That could start happening more often if Trump during his presidency uses Mar-a-Lago for breaks from the White House.“Maybe the issue took care of itself,” County Commissioner Steven Abrams said. “I think he has more important things on his agenda now.”Trump in 1985 purchased the 18-acre estate that reaches from the Lake Worth Lagoon to the Atlantic Ocean. He restored the building and 10 years later converted it to a private club, which this year was the site of numerous Trump news conferences and other presidential campaign events.Since 1995, Trump has been using court fights to try to re-route aircraft traffic from the county’s airport, located 2.5 miles west of Mar-a-Lago.Trump has maintained that noise, vibrations and emissions from airplanes damage the estate, a National Historic Landmark built in 1927 as a home for Post cereal heiress Marjorie Merriweather Post.The crescent-shaped, Mediterranean-style building with a 75-foot-tall tower has suffered damage to floors, roofs and columns due to the passing plans, according to the 2015 lawsuit.The lawsuit also maintained that ongoing aircraft traffic disrupted Mar-a-Lago’s “once serene and tranquil ambience.”Trump argued that, in response to his legal challenges, officials had concentrated air traffic over Mar-a-Lago, instead of fanning out flights out in different directions.Trump had been seeking $100 million in damages for the air traffic “creating an unreasonable amount of noise, emissions and pollutants at Mar-a-Lago,” according to the lawsuit.Last year a judge dismissed four of the six counts of Trump’s lawsuit, finding that it failed to show that the flyovers were too low or that the county was responsible for the flight paths.
