Those errors may have contributed to an assessment of risk that the judge wasn’t willing to accept on Oct. 4.“It is critically important to me when I come to decide what is the appropriate sentence for Mr. Davis, in addition to all of the other purposes and principles and sentencing, to look at rehabilitation and whether that’s possible,” said the judge. “I don’t know how I can do that without an accurate risk assessment, which is specifically why I had asked that it be part of the process.”Davis had been found guilty earlier in 2023 of possessing 369 images, 259 that were unique images, and one video on his cellphone, all of which constituted the definition of child sexual abuse material.The concerns about the report were shared by Crown, defence and the judge. An order to correct the report was made for the assessor instead of making a whole new report.Information on a sealed case against Davis in 2005 was also raised during discussions, particularly that Davis had breached a prohibition resulting from that case about being in contact with children.Defence had concerns about the youth files, and expressed that they should not be part of Davis’ current assessment for risk.
