They presented the argument to a judge on Thursday by saying that the former president is immune from prosecution for the actions he took while in office. “Breaking 234 years of precedent, the incumbent administration has charged President Trump for acts that lie not just within the ‘outer perimeter,’ but at the heart of his official responsibilities as President," the defense motion states. “In doing so, the prosecution does not, and cannot, argue that President Trump’s efforts to ensure election integrity, and to advocate for the same, were outside the scope of his duties.”Recently, Trump's lawyers asked the U.S. District Judge Tanya Chutkan to recuse herself, saying her past public statements about the former president and his connection to the Jan. 6, 2021, riot at the U.S. Capitol call into question whether she can be fair.Prosecutors with special counsel Jack Smith's team wrote in a court filing that there was "no valid basis" for Chutkan to recuse herself.While Trump lawyers continue to try to dismiss the case, prosecutors keep moving forward. Twitter, the social media platform now known as X, turned over 32 direct messages from Trump's account to the Department of Justice in September. The content of the private messages was not immediately known.However, the filings noted that Trump "propagated false claims of fraud (including swearing to false allegations in a federal court filing), pressured state and federal officials to violate their legal duties, and retaliated against those who did not comply with his demands, culminating in violence at the U.S. Capitol on January 6."Editor's Note: The Associated Press contributed to this article.
