It’s just a summons. By elevating it to a misdemeanor the police doesn’t have to witness it, you have a witness who experienced it.”Under the proposed change, transit spitters could face up to a year in jail if they’re convicted.AdvertisementClark acknowledged that many of the people who spit on transit workers are mentally ill — and said her office isn’t hellbent on sending unhinged New Yorkers to jail, but instead connecting them with services to get treatment.“The resolution of cases happens in different ways,” she said. “It could be diversion, it could be making sure they get the mental health services they need, it could mean going to state prison.”Transport Workers Union Local 100 — which represents just over half of the Metropolitan Transportation Authority’s 70,000 employees — have for years pushed for harsher crackdowns on people who spit on their members.Local 100 president Tony Utano said the blame for the problem — and a recent series of frightening assaults and stabbings by homeless people on the subway — should be placed on Mayor de Blasio.“The mayor should fix up these homeless shelters. Get some doctors in there, get some education in there, get them some counselors so these people know they’re going some place to get help, not to get in trouble,” said Utano. “People need to step up and it’s the mayor and the politicians who need to fix this problem.“We are tired of going home with blood on our uniforms,” Utano added. “We are tired of getting spit on.” Advertisement
