OWASSO, Okla. — A private school in Owasso could have opened itself up to legal action after expelling a 2nd-grade girl over a “crush” on another girl.Delanie Shelton said her 8-year-old daughter, Chloe was kicked out of Rejoice Christian School because Chloe told another girl she had a crush on her. that received federal COVID-19 relief money through the CARES Act’s Payroll Protection Program (PPP) last summer.Tulsa attorney Daniel Smolen says the federal funding received by Rejoice opens doors to multiple potential claims and lawsuits.”Once they receive those funds they really open themselves up to Title IX liability for that type of liability,” Smolen says.“And beyond that you have state law claims of emotional distress that they won’t be shielded from.”Under Title IX, Smolen says schools can’t discriminate against race, religion and sexual orientation.However, if Rejoice is taken to court, Smolen says the school can argue Chloe’s actions violated their student handbook.FOX23 has reached out to Rejoice for further comment and has not heard back.Cox Media Group
