Phipps, 48, was arrested on Tuesday on charges of knowingly entering or remaining in any restricted building or grounds without lawful authority and impeding or disrupting official functions; and violent entry and disorderly conduct on Capitol grounds.Phipps is at least the eighth North Texan to be charged in connection with the violent Jan. 6 uprising in Washington D.C.An attorney was not assigned to him as of Wednesday morning.The FBI on Jan. 12 received information from a Fort Worth Police analyst who monitors social media for threats, a federal complaint said. The analyst was “asked to help locate local residents who participated in violence or illegal activity” during the riot.Phipps had expressed interest in a Facebook post about spots available on a bus that was planning to travel to Washington for a Jan. 6 “protest,” according to the complaint.The post said: “ATTN: The founder of Stop The Steal has got a bus from DFW to DC. There are 50 spots available and cost $50 round trip. Please go to the link below, and send your email and phone number so we can register you on the official STOP THE STEAL BUS! #MAGA.”On Jan. 8, Phipps posted a photo on Facebook of him inside the Capitol building holding an American flag, the complaint said. And he said in another post that “Everyone talks about being a patriot until its time to do patriot [expletive],” the complaint says.“I went to DC. I helped take the Hill,” Phipps allegedly wrote. “I helped other patriots prevent antifa from damaging anything.”He allegedly added: “I exercised my 1st amendment right to take grievances to our representatives. It was a (mostly peaceful) political protest. Where were you on 06JAN21?”A witness identified Phipps “from the neighborhood,” the FBI says.On Jan. 18, Phipps posted on Facebook that he “just got out of FascistBook jail,” an apparent reference to a suspended account.“For those who may be wondering, no, the FBI is NOT after me because I’m on video fighting with antifa and cooperating with law enforcement. I exercised my 1st Amendment rights,” Phipps said in the post.Phipps’ recent Facebook posts had complained of a “rigged” and “stolen” election, and he shared unsubstantiated claims of election fraud. In late December, he posted a meme that said: “Hey Marxists, Trump is coming on January 6th. And the deplorables are coming with him!”Phipps’ Facebook account says he studied at American Flyers Flight School and AMI American Motorcycle Institute.
