KENT: COURT RECORDS SHOW THAT 42-YEAR-OLD DAVID CHARLES MISH OF WEST ALLIS IS FACING CHARGES OF UNLAWFUL ENTRY ON RESTRICTED GROUND AND DISORDERLY CONDUCT ON CAPITOL GROUNDS. HE MADE A VIRTUAL APPEARANCE IN FEDERAL COURT ON FRIDAY. INCLUDED IN THE COURT DOCUMENTS ARE IMAGES WHICH SHOW MISH INSIDE THE CAPITOL DURING THE UNREST. THOSE DOCUMENTS STATE THAT MISH PLACED A PHONE CALL TO D.C. METRO POLICE ON THE DAY AFTER THE INSURRECTION, SAYING HE HAD INFORMATION ABOUT A WOMAN WHO WAS SHOT AND KILLED AS SHE TRIED TO BREACH A DOORWAY INTO THE SPEAKER’S LOBBY. THE DOCUMENTS SHOW MISH ASKE D.C. POLICE, "BECAUSE I ENTERED THE CAPITOL BUILDING ARE YOU GUYS GOING TO TAKE ME TO JAIL?" ADDING, "I DIDN’T BREAK ANYTHING, I WENT IN, YES." WE WERE UNABLE TO REACH MISH FOR COMMENT TODAY. THE JUDGE RELEASED MISH ON HIS OWN RECOGNIZANCE, BUT ORDERED THAT HE NOT ATTEND ANY IN-PERSON POLITICAL DEMONSTRATIONS, AND THAT HE STAY AWAY FROM WASHINGTON, D.C. Metropolitan Police to provide information about the shooting.A detective told Mish separate agencies were involved in Capitol breach investigation and the detective cold not say whether Mish would be arrested, the records show."I didn't break anything," Mish told the detective. "I went in, yes."The records said the subsequent review of video footage indicated Mish was at the door leading to what is known as the Speaker's Lobby.Mish, according to the documents, recalled Babbitt telling an officer at the door, "Just open the door. They're not gonna stop." He said he used his cellphone to record some of what was unfolding inside the Capitol."From my video, you can tell that I was one of the, I was the first group of people to hit that doorway," an investigator said Mish told them, referring to the locked door way to the Speaker's Lobby. Mish, according to the records, offered to provide video footage to the detective. Detectives wrote neither they nor the FBI had been able to access the content of the link Mish sent.Later on, the records indicate, investigators reviewed additional national news coverage of the attack on the Capitol and the scores of individuals who were inside. Based on the description Mish gave investigators of himself, his driver's license, and videos from other sources including YouTube, investigators identified Mish in the videos."Black sweater...blue jeans...blue lives matter with a...United States flag on the had and the hat is blue," they wrote. In the documents, investigators circled the face of a man they said was Mish.The records show Mish is charged with unlawful entry on restricted buildings or grounds and violent entry and disorderly conduct on capitol grounds.If convicted on the charges, he faces a maximum of 18 months in prison and $105,000 in fines. Mish made an initial appearance in court Friday with his attorney. The Honorable William E. Duffin ordered Mish be released on his own recognizance with the agreement he would stay away from Washington, D.C., and not be involved in in-person political protests.
