TODAY WE HEARD TESTIMONY FROM THOSE BUSINESSES ABOUT HOW MUCH THAT RESTRICTION HAS HURT THEM COSTING THEM MONEY CAUSING SOME OF THEM TO LAY PEOPLE OFF. WE ALSO HEARD FROM STATE OFFICIALS LIKE THE COMMISSIONER OF HEALTH IN THE STATE CO O ABOUT HOW THE GOVERNOR CAME TO THE DECISION OF PUTTING THIS RESTRICTION IN PLACE. THEY TALKED ABOUT GOOGLE ANALYTICS DATA THAT THEY RELIED TO MAKE THAT DECISION ACCORDING TO TESTIMONY. THAT’S WHAT WE HEARD TODAY THE JUDGE SUSAN STALLINGS QUESTION THE USE OF THAT DATA. TO SEE ALSO ASKED ABOUT WHY THE GOVERNOR HASN’T ISSUED A MASK MANDATE STATEWIDE THAT SHE SAID WOULD APPLY TO EVERYONE SHE SEEMED SKEPTICAL OF WHY THIS RESTRICTION IS ONLY BEING ENFORCED ON PLACES THAT SERVE ALCOHOL THROUGH THE ABLE COMMISSION INSTEAD OF PERHAPS ON ALL BUSINESSES THAT ARE OPEN AFTER 11 P.M. HERE’S THE ARGUMENT THAT WE HEARD TODAY AFTER THAT HEARING FROM THE LAWYER FOR THE BUSINESSES. THEY DO NOT HAVE THE LEGAL AUTHORITY TO DO WHAT THEY ARE TRYING TO DO. THE GOVERNOR DOES NOT HAVE THE AUTHORITY TO ISSUE FIAT’S THAT HAVE THE FORCE AND EFFECT OF LAW AND THE ABLE COMMISSION DOES NOT HAVE THE AUTHORITY TO GO AND ENFORCE THOSE EXECUTIVE ORDERS. AND OF COURSE ON THE OTHER SIDE THE GOVERNOR CONTENDS THAT HE DOES IN FACT HAVE THAT AUTHORITY ARGUING THAT IT IS AN IMPORTANT STEP TO HELP SLOW THE SPREAD ACROSS THE STATE. SO HERE’S THE SITUATION WE ARE IN RIGHT NOW THAT TEMPORARY ORDER REMAINS IN PLACE BECAUSE OF THAT TEMPORARY ORDER THE ABLE COMMISSION SAID, IT’S JUST NOT GOING TO ENFORCE THIS AT ALL STATEWIDE UNTIL A FINAL ORDER JUDGE STALLINGS DID NOT RULE FROM THE BENCH TODAY. Kevin Stitt’s executive order requires.The businesses sued Stitt over the 11 p.m. requirement. Judge Susan Stallings put a temporary restraining order in place, which she extended Friday. The ABLE Commission, which enforces the state’s liquor laws, has said it won’t seek to enforce the restriction until Stallings makes a final ruling. On Friday, businesses testified about how much the early closing rule hurt them. The state health commissioner and state’s chief operating officer also testified, describing how Stitt came to the decision to enact the restriction. According to today’s testimony, the decision was based in large part on data from Google. Stallings questioned the use of that data and asked why Stitt hasn’t issued a mask mandate, which she said would apply to everyone. Stallings seemed skeptical about why the restriction is only being enforced on places that serve alcohol rather than all businesses that are open after 11 p.m. “They do not have the legal authority to do … to go and enforce those executive orders,” said the businesses’ attorney, Frank Urbanic.Stitt contends he does indeed have the power to do this and that it’s a necessary step to slow COVID-19’s spread.
