Tony Evers and other county elections officials.Evers' team said Trump's lawsuit was improperly filed and should first be considered by a circuit court. "It is a shocking and outrageous assault on our democracy," the filing said. "He has sought relief in the wrong court and has refused to follow the proper steps under the statute that he himself acknowledges governs the appeal of recounts."Evers' lawyers said Trump should have raised his concerns about voting issues before ballots were cast."By focusing on alleged technical violations in only two counties, he has made plain that his intent is not to fairly determine who Wisconsinites voted for to lead our country," the filing said. "He is simply trying to seize Wisconsin’s electoral votes, even though he lost the statewide election."The filing disputed Trump's claims that 221,000 ballots were cast improperly."Voters acted in good faith, believing their votes would count and their will would be done," the filing said. "For good reason, Wisconsin law, federal law, and the United States Constitution all reflect the fundamental principle that a court should not throw out these votes in an after-the-fact attempt to overturn an election."The filing said federal law prohibits denying a person the right to vote based on an immaterial error or omission under state law.Lawyers said any alleged voting violations happened statewide but Trump only wanted ballots excluded in Milwaukee and Dane counties.Evers asked the court to allow attorney from Washington, D.C., New York, Los Angeles and Houston to argue the case on his behalf.The Trump suit includes four instances in which his lawyers claim elections workers illegally altered absentee ballot envelopes, counted ballots that had no required application, overlooked unlawful claims of indefinite confinement and held illegal voting events.The lawsuit asked the votes be excluded from the state's results."My response to this lawsuit is wow, talk about sour grapes. It is so clear that the election is over. Americans have spoken. 80 million people have voted for Joe Biden and Donald Trump just continues to grasp at straws trying to upset elections wherever he can. It's actually a pretty pathetic and desperate move, I think," Milwaukee Mayor Tom Barrett said. "The reality that Donald Trump simply cannot accept is that when you have an election, often times there's a winner and there's a loser. He was the loser. That happens in democracy. He's going to have to come to grips with that because this country and this state is going to move forward."Claire Woodall-Vogg, executive director of Milwaukee Election Commission, said she does not believe this has anything to do with the recount that discovered 386 uncounted ballots. "I was just as appalled to find those ballots during the recount. It was a gross error on our election workers part, but it was a singular error. The recount found very accurate, very transparent election results in counting of absentee ballots, other than that one outlier," Woodall-Vogg said. WISN 12 News' Caroline Reinwald asked Woodall-Vogg why she thinks Trump targeted Milwaukee and Dane counties in his lawduit. "I think the writing is right there on the wall. Milwaukee and Dane county had the most democratic votes. It's where the largest number of voters of color live, largest number of voters who are economically disadvantaged live and it's a direct attack on those voices being heard in our democracy," Woodall-Vogg said. "It's really a floundering attempt to somehow win the Wisconsin election, which we have confirmed that President Trump lost by over 20,000 votes."Trump's lawyers said the Wisconsin Elections Commission directed municipal clerks to illegally alter incomplete absentee ballot envelopes.The lawsuit said under Wisconsin law, only voters could correct incomplete absentee ballot information, not elections clerks.Lawyers claimed clerks illegally issued absentee ballots to voters without a required application.The suit specifically questioned all ballots cast during the early in-person voting period.Trump's lawyers claimed clerks issued ballots to voters who did not show identification and to voters who said they were indefinitely confined but could vote in person.The lawsuit said Madison also created unlawful polling locations in 200 parks.Voters are not allowed to turn in their absentee ballots anywhere other than the designated polling locations, lawyers said.Evers' response said the practices were widely accepted in Wisconsin's elections.“The people of Wisconsin deserve election processes with uniform enforcement of the law, plain and simple. During the recount in Dane and Milwaukee counties, we know with absolute certainty illegal ballots have unduly influenced the state's election results. Wisconsin cannot allow the over 3 million legal ballots to be eroded by even a single illegal ballot,” said Jim Troupis, counsel to the campaign. “We will continue fighting on behalf of the American people to defend their right to a free and fair election by helping to restore integrity and transparency in our elections.”"As we have said from the very beginning of this process, we want all legal votes and only legal votes to be counted," said Rudy Giuliani, former New York City mayor and personal attorney to President Trump. "Americans must be able to trust in our election results, and we (will) not stop until we can ensure voters once again have faith in our electoral process." The Wisconsin Elections Commission officially confirmed the statewide results on Monday.Elections officials have maintained there was no evidence of widespread voter fraud or misconduct.Evers signed the certification Monday afternoon.During a Wisconsin Elections Commission meeting Tuesday, member Dean Knudson accused the chair of breaking the law and called for her resignation."Number one, I am not withdrawing this chair," Ann Jacobs said. "Number two, what I did was not illegal.
