AdvertisementAdvertisementArkansas lawmakers file lawsuit against Department of HealthDan Sullivan, an Arkansas State Representative and Senator-elect out of Jonesboro, plans to file a declaratory judgement against Dr. Jose Romero and the ADH on Thursday, September 3.“This is really about the separation of powers,” said Sullivan. “In this case, several of us, several thousand around the state, believe the governor has overstepped his authority by granting the secretary of the department of health the ability to not only enforce law, but to make law.”In a press release, Sullivan said "The suit will seek an end to the perpetual state of emergency that for the last five months has restricted the rights of citizens of Arkansas to operate and restore their businesses, assemble in their churches, visit the eating establishments of their choice and associate with family and friends without undue government restrictions. ADH has violated the Administrative Procedures Act (APA) for many months by issuing directives without oversight by the duly elected and representative legislature." “And it’s vitally important as a legislator, that I protect the ability for my constituents to have a voice in Little Rock,” said Bob Ballinger, Arkansas State Senator for District 5, and a supporter of the lawsuit . “I carry with me 90,000 people. I carry their voice into the legislature. And so it's important that the legislature and the legislators, step up and do all they can to be able to protect the voice of their constituents”Supporters of the lawsuit will be gathering on the capitol steps on September 3rd at noon, the same time it will be filed. However, not all state lawmakers support this lawsuit.“We all want the fastest way to make sure that happens to all of us to do what experts and doctors recommend, which is to wear masks keep our distance, wash your hands and take all other appropriate steps to rein in our numbers,” said Greg Leding, Arkansas State Senator for District 4. “It really is that easy.
